SOUTH AUSTRALIA - COOPERS X ALH ON PREMISE, ENTER TO WIN A COOPERS BREWERY VIP EXPERIENCE PROMOTION – JAN 2025 TERMS AND CONDITIONS

 1. Information on how to participate/claim and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to South Australian residents aged 18 years or over.

3. Employees (and their immediate families) of the Promoter, Participating Venues (defined below) and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences at 12:01am (ACDT) on 6 January 2025 and ends at 11:59pm (ACDT) on 2 February 2025, or when all prizes are distributed, whichever is earlier (Promotional Period).

5. The promotion will be run in up to thirty seven (37) ALH Venues in South Australia only. Participating Venues are only those venues as provided for in Schedule 1 that elect to participate in the Promotion, by displaying relevant signage regarding the Promotion, (each a “Participating Venue”).

6. To be eligible to enter, individuals must purchase any Coopers tap beer product in a Participating Venue during the Promotional Period (“Qualifying Transaction”) and scan the QR code provided to them at the point of purchase. It is the responsibility of the entrants to ensure that they scan the QR code at point of purchase.

7. Once the individual has scanned the QR code, it will take them to the entry webpage to complete an entry form, where entries can be made in accordance with these terms.

8. To enter the draw, after completing their Qualifying Transaction, during the Promotional Period, entrants must:
a. make a Qualifying Transaction in a Participating Venue;
b. visit https://coopers.com.au/pages/alh-win-a-coopers-brewery-vip-experience-promotion (either by the provided QR code or manual entry) (Promotional Website);
c. follow the prompts to the promotion entry page;
d. fully complete, in the manner required, the online entry form, including providing the Entrant’s first name, last name, current and valid email address, mobile phone number, suburb, postcode, and date of birth; and
e. successfully submit the fully completed entry form, in the manner required.

For clarity, all valid entries received from winners and non-winners are eligible to enter the unclaimed prize draw.


9. Each Entrant acknowledges and agrees that the promotion and these Conditions of Entry are governed by the laws of South Australia and each Entrant submits to the non-exclusive jurisdiction of the courts of South Australia and any courts competent to hear appeals from those courts.

10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and reserves the right to, in its sole discretion, disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, submitted an entry not in accordance with these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

11. Incomplete or indecipherable entries will be deemed invalid.

12. Costs associated with accessing the Promotional Website, or otherwise engaging in the Promotion, remain the responsibility of the Entrant and may vary depending on the internet service provider used.

13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. Prizes will only be awarded where the entry fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.

14. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce any reasonable information in order to confirm the Entrant’s identity and eligibility to enter and claim a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction, then the entry of that Entrant will be ineligible and deemed invalid.

15. Multiple entries permitted, subject to the following:
a. only one (1) entry is permitted per Qualifying Transaction regardless of the number of Coopers beer products in excess of one (1) is purchased in that transaction;
b. a maximum of two (2) entries are permitted per person per day in a Participating Venue; and
c. each entry must be submitted separately and in accordance with these Terms and Conditions.

16. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. Errors or omissions in entries may be accepted at the Promoter’s sole discretion.

17. This is a game of chance, and the winners will be drawn randomly from Eligible Entries. The first Eligible Entries drawn will win. The Promoter’s decision is final, and no correspondence will be entered into.

18. The total number of prizes to be won is four (4). Each prize consists of one (1) trip for two (2) people to the Coopers Brewery Visitors’ Centre on Friday 9th May, 2025 at 11am, valued at up to $700 (inc. GST). The total prize pool for the Promotion is $2,800 (inc. GST), comprised of four (4) individual prizes. Itinerary will be selected/directed by the Promoter and confirmed to the winner in advance.

19. Four (4) individual winners will be selected. Each entry, and winner, may only win one prize. Prizes are not transferable and must be taken on Friday 9 May 2025 at 11:30am (ACDT). The identifiable entrant of the entry form must be the collector of the prize.

20. The draw will take place at Coopers Brewery, 230 Regency Rd, Regency Park SA 5010 on 10 February 2025 at 12:00PM (midday) (ACDT). The first four (4) valid entries drawn will win the prizes as advertised in the Promotion. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn, or a winner is otherwise unable or unwilling to collect their prize.

21. Winners will be contacted via email within 48 hours of the draw to notify them that they have won, and their names will be published at www.winwithcoopers.com.au/winners no later than 17 February 2025. All reasonable steps will be taken by the Promoter to notify the winner of the results.

22. If Coopers Brewery is unable to contact the winner within 48 hours of the draw and Coopers Brewery has made every effort to contact them with the information provided by the entrant then Coopers Brewery will award the prize to another valid entrant.

23. A draw for any unclaimed prizes may take place (if no valid, additional reserve entries have been drawn per clause 20) on 17 March 2025, at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners of any unclaimed prize draw (if any) will be notified in writing via email within 48 hours of the new draw and published in the same manner as the original draws.

24. Subject to the unclaimed prize draw clause above, if for any reason a winner does not take a prize by the time stipulated by the Promoter, the prize will be forfeited.

25. The Prize will be delivered to the winner once they have accepted the Prize and provided information required for delivery.

26. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize at their discretion with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

27. The Promoter’s decision is final and no correspondence will be entered into.

28. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by war, terrorism, state of emergency, pandemic, vandalism, power failures, natural disasters, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right, subject to any written directions of the lottery authorities, to cancel, terminate, modify or suspend or recommence the Promotion.

29. Prize values are correct as at the date of preparing these Terms and Conditions, are provided for in Australian Dollars, and include all applicable GST.

30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised, intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

a. To disqualify any entrant; or
b. Subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

31. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.

32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

33. Except for any liability that cannot by law be excluded, including the No Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

a. any technical difficulties or equipment malfunction, delays or failures, including those resulting from accessing any materials related to this promotion (whether or not under the Promoter’s control), and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures;
b. any theft, unauthorised access or third-party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. any variation in prize value to that stated in these Terms and Conditions; or
e. any tax liability incurred by a winner or entrant;

34. As a condition of accepting a prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

35. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

36. The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promotor will also us and handle PI as set out in its Privacy Policy (which can be viewed at https://coopers.com.au/privacy). In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, or complain about a breach of the Australia Privacy Principles or any other applicable law and how those complaints will be dealt with. Entrants should direct any request to opt out, access, update or correct PI to the Promoter. All entries become the property of the Promoter.

37. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects PI about an Entrant to include the Entrant in the promotion and, where appropriate, award a prize. If the PI requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. All personal information will be stored at the office of the Promoter.

38. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.

39. Each Entrant acknowledges and agrees that the promotion and these Conditions of Entry are governed by the laws of South Australia, Australia and each Entrant submits to the non-exclusive jurisdiction of the courts of South Australia, Australia and any courts competent to hear appeals from those courts.
