COOPERS x COOPERS ALEHOUSE ADELAIDE AIRPORT ENTER TO WIN A CRUISE FOR 2 PROMOTION – MAR 2024 

 

1. Information on how to participate/claim and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over.

3. Employees (and their immediate families) of the Promoter, Participating Venues (defined below) and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. The promotion will be run in the Coopers Alehouse, Adelaide Airport (“Participating Venue”). The promotion commences in the Participating Venue from 12.01am local time on 18 March 2024 and ends at 11.59pm local time on 24 April 2024, (“Promotional Period”).

5. This Promotion is undertaken, and the Prize provided, in partnership with, and facilitated by Phil Hoffmann Travel. The winner is required to comply with any terms and conditions provided by Phil Hoffmann Travel, including, but not limited to, privacy policies and travel booking conditions.

6. To be eligible to enter, individuals must purchase a Coopers beer in a Participating Venue during the Promotional Period (“Qualifying Transaction”) and scan the QR code provided to them at the point of purchase. It is the responsibility of the entrants to ensure that they scan the QR code at point of purchase.

7. A participating venue will not offer this promotion as an inducement directed at encouraging patrons to gamble in line with relevant state gambling authorities.

8. Once the individual has scanned the QR code, it will take them to the entry webpage to complete an entry form, where entries can be made, per clause 9.

9. To enter the draw, after completing their Qualifying Transaction, during the Promotional Period, entrants must:
take a picture of or with their Coopers Beer at Adelaide Airport;

  • submit their picture and required data via Coopers promotional website: www.coopers.com.au/holidays-brewing;
  • fully complete, in the manner required, the online entry form, including providing the Entrant’s first name, last name, current and valid email address, mobile phone number, suburb, postcode, and date of birth; and
  • successfully submit the fully completed entry form, in the manner required.

10. For clarity, all valid entries received from winners and non-winners are eligible to enter the unclaimed prize draw.

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence), based on the information provided to it, and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

12. Costs associated with accessing the Promotional Website, or otherwise engaging in the Promotion, remain the responsibility of the Entrant and may vary depending on the internet service provider used.

13. Multiple entries permitted, subject to the following:
(a) only one (1) entry is permitted per Qualifying Transaction regardless of the number of Coopers beers in excess of one (1) is purchased in that transaction;
(b) a maximum of one (1) entry permitted per person per day in a Participating Venue; and
(c) each entry must be submitted separately and in accordance with these Terms and Conditions.

14. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

15. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. The Promoter accepts not responsibility for late, lost or misdirected entries. Errors or omissions in entries may be accepted at the Promoter’s sole discretion.

16. The total number of prizes to be won is one (1) The prize consists of one (1) Fiji & South Pacific 13 night cruise with Princess Cruises for 2 people, provided for by Phil Hoffmann Travel. One winner will be selected, and the first valid entry drawn will be the winner. Each prize includes:
(a) Return, economy class flights with the airline of the Promoter’s choice from the Prize Recipient’s nearest capital city (Melbourne, Brisbane, Perth, Adelaide, Sydney, Darwin, Canberra or Hobart) to Sydney. Prizes for Prize Recipients in NSW do not include airfares, unless otherwise advised by the Promoter, and NSW Prize Recipients will be responsible for all travel costs associated with taking the prize, including but not limited to travel to and from Sydney;
(b) One (1) night accommodation in a minimum 3-star hotel on the night of 27 October 2024.
(c) Return transfers between Sydney Airport and the accommodation, and between accommodation and cruise departure/arrival point (if flights have been provided);
(d) Cruise Sydney Roundtrip on Royal Princess. Itinerary: Noumea, New Caledonia, Mystery Island, Vanuatu, Suva, Fiji , Dravuni Island, Fiji, Lautoka, Fiji.

17. The total prize pool for this promotion is up to $7,000 (depending on the value of flights). Each Qualifying Transaction may only win one prize and each prize is not transferable. The identifiable entrant of the entry form must be the collector of the prize. The winner’s details will be disclosed to Phil Hoffman Travel (in accordance with these Terms and Conditions) to facilitate delivery of the prize. The Prize will be emailed to the winner, to the email address provided by the winner, once they have accepted the Prize and provided information required as outlined in section 9.

18. Spending money, additional meals, additional accommodation costs, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken at the times provided for the Cruise, with flights departing on 27 October 2024, and is subject to booking and flight availability. The Prize Recipient and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter and Phil Hoffmann Travel in their absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Prize Recipient may be required to present their credit card and other identification at certain points of travel.

19. It is the sole responsibility of Entrants to ensure that they have a valid Australian passport (or other legal clearance to undertake the travel offered by the Prize) and any desired travel insurance. The Promoter accepts not responsibility for travel insurance or other additional costs associated with travel (including but not limited to excess baggage, seat changes, etc.)

20. To redeem the prize, the winner must make contact with Phil Hoffmann Travel on (08) 8350 5700 within 7 days of accepting the prize and quote reference 36040. Extensions, alterations, and upgrades are subject to availability and at Prize Recipient’s own expense. Cruise part of the Prize based on voyage 1432 departing 28 October 2024 in an inside cabin. Similar voyages depart 29 December 2024 and 16 March 2025, however a surcharge may apply to book on these departures. Prize based on Princess Standard Fares. Surcharges may apply. Prizes cannot be substituted and cannot be combined with other promotional offers. Transfers, cabin upgrades, travel insurance and items of a personal nature are not included and are at an additional, personal cost to the Prize Recipient. Phil Hoffmann Travel reserves the right to substitute the prize to the same or a similar prize of equal or greater value, subject to consumer laws. Phil Hoffmann Travel accepts no responsibility for change in prize value between now and the Redemption Date. Vouchers are not transferable or redeemable for cash, traveller’s cheques, foreign currency, or other credit. Additional Princess Cruises condition apply. Phil Hoffmann Travel Bookings Conditions and advisory services apply.

21. The draw will take place at 461 South Road Regency Park SA 5010 on 26 April 2024 at 12:00PM (noon) AEST. The first valid entry drawn will win the prize/s as advertised in the Promotion. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing via email within seven (7) business days of the draw and their names will be published at https://www.coopers.com.au/holidays-brewing; no later than 27 April 2024.

22. This Promotion is a game of chance and the winner will be drawn randomly from Eligible Entries. The first valid entry drawn will win. The Promoter's decision is final and no correspondence will be entered into.

23. A draw for any unclaimed prizes, may take place on 6 May 2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing via email within seven (7) business days of the new draw and their names published online at https://www.coopers.com.au/holidays-brewing; no later than 7 May 2024.

24. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

25. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize at their discretion with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

26. Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value.

27. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

29. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant as invalid.

30. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion, including prize claims, is subject to the licensee's liquor serving policy.

31. Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify, the statutory consumer guarantees as provided for under relevant Competition and Consumer legislation of each jurisdiction, as well as any other implied warranties under the ASIC Act (or similar consumer protection laws in the States and Territories of Australia, or New Zealand) (Non-Excludable Guarantees).

32. Except for any liability that cannot be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including for negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but no limited to:
(a) Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control), delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures;
(b) Any theft, unauthorised access or third-party interference;
(c) Any entry or price claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) Any variation in prize value to that stated in these Terms and Conditions; or
(e) Any tax liability incurred by the winner or entrant;

33. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media (including the Promoter’s Social Media) for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

34. The Promoter collect personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://coopers.com.au/privacy.. In addition to any use that may be outlined in the Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.

35. Phil Hoffmann Travel will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.pht.com.au/privacy-policy. The Promoter will disclose PI obtained in this Promotion to Phil Hoffmann Travel. Any queries relating to Phil Hoffman Travel’s use and retention of PI, or how to opt out, access, update or correct such information, should be directed to Phil Hoffmann Travel. The Promoter accepts no responsibility for Phil Hoffmann Travel’s use and retention of PI.
